PHOTOGRAPHY
By booking your shoot and paying your booking confirmation fee (25% of the total amount), the client agrees to the photo session terms and conditions.
PHOTOSHOOT AGREEMENT TERMS
The photographs will be edited within the promised timeframe. It is my policy to never release any unedited pictures in any form to anybody, including the client..
CANCELLATION AND POSTPONING (where applicable)
Client understands that by entering into this agreement, I am foregoing other photographic jobs. In the event of a cancellation or postponement of the photographic session/agreement by client, the amounts paid are nonrefundable.
WEATHER (where applicable)
If it is not possible for the shoot to take place on a scheduled day due to weather, we will reschedule on an agreed date at the earliest date possible with no additional charge.
COÖPERATION
I am not responsible if the client and/or key individual fail to cooperate or appear during photo shoots.. If the client and/or key individuals fail to arrive to a scheduled photo shoot the full amount is non-refundable.
RESHOOTS - CAMERA FAILURE OR EXPOSURE PROBLEMS
In the unlikely event that the finished product from a photo shoot is unusable due to technical problems, (camera failure or exposure problems), I will re-shoot at no additional charge.
INVOICING AND PAYMENTS
Payments are made to the account number BE83 7360 4556 5715 after the invoice has been sent and before the images have been delivered. Amounts are due within 30 days after the invoice date. After the payment term has elapsed, the following are owed and without any notice of default:
- an invoice interest of 1% per month for every month started.
- A damages clause of 10%
In the event of late payment, Iris Kelly Kuntkes reserves the right to suspend all further activities until full payment of the invoice amount has been obtained.
COPYRIGHT AND WATERMARK
All images are copyrighted to and remain property of Iris Kelly Reflections. The client will receive the promised amount of edited pictures with and without watermark. The pictures without watermark are meant to be used for prints and the pictures with watermark are meant to use online.
CLIENTS USAGE
Client is obtaining prints for personal use only. The client is not permitted to sell any prints of pictures made by Iris Kelly. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Iris Kelly. A credit line that reads “Photo by Iris Kelly Kuntkes" in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs. The client is not allowed to edit the pictures or to use any filters. For publications in any form, you need to pay a license fee.
MODEL RELEASE
Client grants to Iris Kelly the irrevocable and unrestricted right to use and publish photographs of the client, client’s child or children, or in which the client may be included for editorial, trade, advertising and other related purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases me from all claims and liability relating to said photographs.
EXHIBITION
Client grants me permission to display selected images resulting from this assignment as an example of my work and for submission into photography competitions and releases all claims to profits that may arise from it.
LIMIT OF LIABILITY
I take the utmost care with respect to exposure, retouching, and transportation of digital captures, proofs and prints. However, in the unlikely event that all the originals are lost, stolen, damaged or destroyed within or beyond my control, my liability is limited to the refund of all payments received, or a re-shoot can be scheduled at no additional cost. In the unlikely event that I am injured or become too ill to attend the photo shoot, I shall make every effort to reschedule to the earliest possible date. If this situation should occur, and the photo shoot must take place on the rescheduled date, I will make every effort to secure a replacement photographer. If this situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received.
PORTFOLIO SHOOTS (TFP)
If I collaborate with a model, stylist, make-up artist or a hairdresser with the intended purpose to expand our portfolio's, said collaborators will have to sign a TFP Contract and will receive the agreed upon amount of pictures with watermark.
